The feasibility, timing, cost and outcome of an individual matter depend on factors including the completeness of evidence, debtor assets, jurisdiction, time limits and advice from the relevant professional team.

Recovery in Hong Kong After Obtaining a Mainland Judgment

The client had obtained a favourable judgment in Mainland China and the case had entered the enforcement stage, but no enforceable assets were identified in the Mainland.

Based on the available leads, World Regal helped cross-check the debtor’s Mainland information, Hong Kong identity and related filing records, linking the Mainland debtor to a Hong Kong identity and identifying Hong Kong property and indications of possible asset transfers.

Qualified Hong Kong legal professionals then handled the relevant legal procedures according to the circumstances, including applications relating to charging and injunctive measures. The debt was ultimately recovered and further transfer of the relevant assets was prevented.

The case has been anonymised and only key handling stages are shown. Outcomes depend on the evidence, asset position and applicable legal procedures in each case.

Bank Funds Identified from Activity Leads and Successfully Enforced

Although the client had already obtained a favourable judgment, no enforceable assets could initially be found and conventional information leads appeared to have been exhausted.

The team conducted field and activity-based enquiries using the debtor’s address and identified a bank statement among discarded materials, providing key information about a bank account and the approximate amount of funds.

Qualified Hong Kong legal professionals then used the relevant information to progress garnishee proceedings. Funds in the bank account were attached by court order and more than HK$1.92 million was ultimately recovered.
